The EB-2 National Interest Waiver (NIW) is a US green card route that lets qualified professionals apply without a job offer or employer sponsor. Instead of an employer proving that no US worker is available, you show that your work benefits the United States enough to waive that requirement.
Who it's for
Professionals, researchers, and founders who first meet the EB-2 baseline:
- An advanced degree: a master's or higher, or a bachelor's plus five years of progressive experience; or
- Exceptional ability in the sciences, arts, or business.
The three-prong test
US Citizenship and Immigration Services (USCIS) assesses NIW cases using a three-part test, often called the three prongs. You must satisfy all three.
- 1Substantial merit and national importance. Your proposed work, not just your past work, must have real value and an impact beyond a single employer or local area.
- 2Well positioned to advance it. Your education, skills, track record, and plans show you are likely to succeed.
- 3Beneficial to waive the job offer. On balance, the US gains more by letting you proceed without the usual labour certification process.
Evidence that typically helps
How the process works
Waiting times depend on your country of birth. Applicants from high-demand countries may wait longer for a visa number, even after approval.
Is it right for you?
The NIW suits people with a clear plan and strong evidence of impact. Reviewing your profile against each prong before you file helps you understand where your case is strong, and where it needs more support.
